C-270 – the Stopping Internet Sexual Exploitation Act – requires makers and distributors of porn to verify the age and consent of anyone in their content.
Offence
The first new requirement from C-270 is that the makers of porn need to verify the age of their models as well as get their express consent to have their image depicted in the material. Age verification needs to be done with a piece of government ID.
Distributors of porn will need to get written confirmation that everyone in the material is 18 or older, have given their consent to have their image be in the material, and have not withdrawn their consent.
Punishment
Anyone convicted of one of these offences can be punished with a fine of up to $500,000 and/or up to two years in prison.
Anyone who’s convicted can also be put under the following court orders:
- No access to the internet except as approved by the court (such as workplace use)
- Removal of the offending porn from the offender’s computer system
- Removal of the offending porn from the internet and any other networks
Anyone that breaks from these orders can be sentenced to up to two years in prison.
Regulations
The Governor General will be able to create regulations about what type of ID can be used for age verification. They’ll also be able to create regulations on how long any documentation on age verification or consent needs to be kept.
Progress of C-270
C-270 went up for its Second Reading vote and passed with everyone voting in favour. It is now being reviewed by the Committee on Justice and Human Rights (JUST).
