C-274 – An Act to amend the Criminal Code (detention in custody) – requires anyone charged with certain crimes be held in custody while waiting for their appearance in court.
This applies to anyone who’s charged with more than two crimes that are punishable with at least five years in prison. The judge has the ability to override this if they’re convinced there are exceptional circumstances that justify releasing the accused.
Progress of C-274
C-274 is currently outside of the Order of Precedence.
