C-390 – An Act to amend the Criminal Code (provincial medical assistance in dying framework) – allows provinces to create their own frameworks for providing MAiD.
This is a pretty simple one, the only real note is that the provincial frameworks are meant to allow people to request MAiD in advance if they have an illness that will eventually result in them being unable to consent to care. The focus on allowing provinces decide how to handle this is because the Quebec National Assembly has asked for the ability to allow this, but are limited by what the federal legislation allows. It’s worth noting that people will qualify for MAiD if they meet either the federal or provincial requirements. This Act won’t allow the provinces to deny access to MAiD to people that meet the federal requirements, they’ll only be able to increase the number of situations that qualify.
