C-413 – An Act to amend the Criminal Code (promotion of hatred against Indigenous peoples) – makes it illegal to condone, downplay, deny, or justify the residential school system and its impact on Indigenous groups.
So an important bit to mention here is that this doesn’t apply to private conversation. The main target here is the broadcasting of misinformation around residential schools, so unless you’re publishing incorrect information for a large audience you’re fine. This also doesn’t affect:
- Anyone that can establish that their statements are true
- Anyone expressing a religious belief in good faith
- Anyone making statements relevant to national interest that they believe are true
Someone who goes against this Act can be punished with up to two years in prison, though court cases will only proceed if the Attorney General approves it.
