C-339 – An Act to amend the Competition Act (efficiencies defence) – removes the “efficiencies defence” for mergers from the Competition Act.
At the moment, when considering if a merger should be allowed, one of the things the Competition Tribunal needs to look into any potential increases in efficiency that would result from the merger. If the efficiency offsets the loss of competition then the Tribunal isn’t allowed to block the merger.
C-339 removes this, so even if a merger would result in increased efficiencies the Tribunal is allowed to block or put conditions on it.
Progress
C-339 is currently outside of the Order of Precedence and is waiting for its chance to be brought to the House.
