C-263 – The Responsible Business Conduct Abroad Act – creates the Commissioner for Responsible Business Abroad to help prevent businesses from committing human rights abuses abroad.
There isn’t a lot in this Act that’s any surprise. It sets out the usual system for filing complaints of abuse with the Commissioner, the procedure for the Commissioner launching an investigation against a business, the penalties for lying to the Commissioner, and all the normal reporting requirements.
Of note here are the businesses the Commissioner would be responsible for. The businesses include anything on a Canadian stock exchange, that does business in Canada, or has assets in Canada and:
- Manufactures/grows/produces/etc goods to be sold abroad
- Imports into Canada goods produced abroad
- Performs services abroad
- Controls a company that performs any of these activities
This does not apply to non-profits or labour unions.
