Bill 5 is set to prevent harassment or workplace violence from members of city councils and local boards

City of Toronto Act/Municipal Act

The code of conduct for members of the municipalities is changed to include the rules regarding workplace violence or harassment in the Occupational Health and Safety Act.

In addition to the standard penalties for harassment, the municipality/board can direct the Commissioner to have the offending member vacate their seat. The Commissioner will be expected to take the case before the judge of the Superior Court to determine if the member has gone against the code of conduct. The Commissioner cannot do this during an election.

If the judge decides that a violation occurred they can declare the member’s seat vacant, and that member is ineligible to be a candidate for any future municipal/board elections for the next two election cycles.
