C-402 – An Act to amend the Marine Liability Act (national strategy respecting pollution caused by shipping container spills) – creates a national strategy to dealing with pollution from shipping container spills.
The Strategy
The Minister of Transport, with help from Indigenous groups, will be responsible for creating the strategy to deal with pollution from these spills. To create the strategy the Minister will first need to conduct a study looking into:
- Identifying gaps in current regulations on pollution caused by shipping container spills
- Reviewing our ability to salvage these spills
- Look at measures that are being taken to prevent, repair, or minimize pollution from these spills
- Examine measures to track containers that are lost at sea
- Assess the adequacy of requirements for ship manifests
- Look at the potential benefits of creating a fund to help clean up pollution damage caused by shipping containers lost at sea
After finishing the study, the Minister will put together the strategy based on their findings. The strategy will need to include measures to:
- Prevent shipping container spills
- Enhance communication between responders, stakeholders, and coastal communities
- Establish a joint spill response task force that includes representatives of the federal and provincial governments, local authorities, Indigenous groups, and commercial fishing groups
- Monitor and remove debris from containers lost at sea
- Address gaps in current regulations around pollution caused by shipping container spills
- Fund research on the impact of plastics and microplastics in water, as well as research on how to remove them
The Minister will need to create this strategy within a year, and they will review it every year after.
